2010 National Defense Authorization Act Early Retirement Provision; and TRICARE Standard for Gray Area Retirees

TAKE Action now on Early Retirement Retroactive issue in the FY 2010 NDAA

The number one issue that needs you to take action now -- in order to get the provision passed - is Early Retirement Retroactive to September 11, 2001 provision this corrects the current law from FY 2008 that allows Guard & Reserve to receive retired pay based on mobilization. 
 

The following provisions should pass this year in the FY 2010 NDAA. We worked tirelessly to get these in the bill:

  • TRICARE Standard Coverage for Certain Reservists Who are Qualified for a Non-Regular Retirement but Are Not Yet Age 60. Retired Reserve who is qualified for a non-regular retirement can purchase a TRICARE Standard health plan paying full cost. Members who are eligible to enroll or enrolled in FEHBP are not eligible for this plan.
  • FY 2010 increase in basic pay.  Effective on 1 Jan 10, monthly basic pay rates for service members are increased by 3.4 percent.
  • One year extension of certain bonuses & special pay authorities. Extends several bonuses/special pays for one year (retention, enlistment, reenlistment, nuc officers, health care professionals, etc.
  • Modification of Servicemembers Civil Relief Act regarding termination or suspension of service contracts & effect of violation of interest rate limitation.
  • Improved Access to Mental Health Care for Family Members of Members of the National Guard & Reserve who are Deployed Overseas. SecDef develop & implement a plan to expand existing initiatives to increase access to mental health care for Guard & Reserve.
  • Continuation on Active Duty of reserve Component Members during Physical Disability Evaluation. Retain on active duty those mobilized or deployed to an area in which imminent danger pay is authorized during the disability evaluation process.
  • Mental Health Assessments. Require person to person mental health assessments for those deployed in support of a contingency mission 60 days before, after deployment at 90-180 days, 6 months, 12 months, & 24 months.
  • Report on Post-Deployment Health Assessments of Guard & Reserve Members.
